Complainants before the Korea Fair Trade Commission will be able to submit opinions before formal hearings begin and will be notified when review proceedings are initiated, under revised rules that take effect Monday.

The Fair Trade Commission announced Monday that it has amended and will enforce its rules on meeting operations and case procedures.

Under the revision, the commission must notify complainants once a review report is placed on the agenda of a plenary or subcommittee session and formal proceedings begin. The commission previously informed complainants of major developments from the start of a case investigation through its final outcome, but the amendment adds notification of the commencement of formal proceedings to that list.

In addition, complainants may now ask an examiner to initiate a preliminary opinion-hearing procedure, allowing them to present their views to commissioners before the main hearing. The preliminary procedure is a step in which the examiner and the respondent state their positions to commissioners and clarify the key issues in dispute ahead of the full hearing.

The complaint form will also be partially revised. For cases involving false or misleading labeling and advertising, complainants will be required to indicate on the form whether they have filed the same complaint with another agency. If such a filing exists, they must provide the name of the agency, the date of filing and the status of that case.

Alongside this, the commission updated relevant provisions — including the definition of examiners — and revised complaint forms to reflect organizational restructuring and amendments to higher-level laws. The commission said it expects the changes to strengthen complainants' procedural rights by expanding both the information provided on case progress and the opportunities to present opinions.
