A man who stabbed his older brother multiple times with a kitchen knife could not escape justice — even as his victim tried to shield him from punishment.

The Seoul High Court's Criminal Division 6-3, presided over by judges Min Dal-gi, Kim Jong-woo and Park Jeong-je, sentenced A, who was indicted on charges of attempted murder, to three years in prison, suspended for four years, according to legal sources Saturday.

A stabbed his older brother, B, multiple times with a kitchen knife during an argument at their home in September last year.

When police arrived at the scene, B told them he had injured himself and tried to hide the weapon.

Even during the victim investigation, B defended his brother, saying, "My brother was not trying to kill me," and, "I also assaulted him."

At the trial stage, B also made clear he did not want his brother punished.

The first-instance court, however, found A guilty of attempted murder and sentenced him to three years in prison.

The appeals court also upheld the guilty verdict but suspended the sentence, citing A's acknowledgment of and remorse for the crime during trial, his payment of his brother's medical bills and subsequent reconciliation, and his responsibility for supporting family members.
