Officials say guidelines can take effect immediately, bypassing the three-month process required for a formal decree

Cheong Wa Dae has decided to issue administrative guidelines — rather than a legally binding enforcement decree — to clarify the scope of permissible labor disputes under the so-called Yellow Envelope Law, an amendment to the Trade Union and Labor Relations Adjustment Act.

A Cheong Wa Dae official said Friday that the presidential office wants to issue guidelines that can take effect at workplaces immediately, rather than pursue a formal decree that would require legislative notice and regulatory review and take more than three months to complete. "The practical effect on the ground is similar," the official said, adding that the government would monitor workplace changes after the guidelines take effect and consider other options if necessary.

Since the Yellow Envelope Law took effect, industry groups have grown increasingly concerned that the expanded definition of employer — extending liability to prime contractors — could expose companies to strikes over decisions such as the distribution of operating profits or the relocation of factory sites. President Lee Jae Myung has repeatedly called for clearer standards on what constitutes a legitimate labor dispute to minimize workplace confusion.

The Ministry of Employment and Labor had maintained that supplementing existing administrative guidelines was preferable to drafting new regulations, citing a lack of explicit statutory delegation in the parent law. Unlike legally binding regulations, administrative guidelines carry no external legal force and function only as internal government standards. The administration said it intends to use the guidelines to quickly communicate to workplaces that decisions falling within a company's inherent managerial authority are not subject to labor disputes.
