A Brazilian woman charged with repeatedly stalking BTS member Jungkook at his home has received a suspended sentence in a first-instance ruling.

If the ruling is upheld on appeal, she could face forced deportation from South Korea.

According to legal sources Tuesday, Judge Park Ji-won of the Seoul Western District Court's Criminal Division 1 sentenced the Brazilian national, identified only as A, to one year in prison suspended for two years on May 8. She had been indicted on charges of violating the Stalking Punishment Act and trespassing.

A is accused of visiting Jungkook's home in Yongsan-gu, Seoul, 22 times over roughly one month beginning Dec. 7 last year, loitering around the property and surveilling it in ways that caused the victim fear and anxiety.

On the first day of the offenses, she rang the doorbell 13 times over about 20 minutes, threw objects over the outer wall and pushed mail through a gap in the gate. On the evening of Dec. 12, she rang the doorbell 133 times through the night. The following evening, she slipped through an unlocked side gate as a food delivery worker was leaving and entered the property without permission.

A was arrested on the spot and released the next day after police warned her not to approach the residence.

Despite the warning, she returned to Jungkook's home immediately after her release, continuing to ring the doorbell and throw mail onto the property.

On Dec. 28 last year, police issued an emergency protective order barring A from coming within 100 meters of Jungkook or his home — a measure designed to physically prevent a stalking suspect from approaching a victim. A court subsequently approved the order.

A ignored the order and on Jan. 4 left photographs and printed materials near the residence, violating the emergency measure. She was ultimately detained and indicted on charges of violating the Stalking Punishment Act and trespassing.

Judge Park said A "committed stalking offenses even after being arrested on the spot, warned by police during investigation and released," adding that "the victim is seeking severe punishment."

However, the court said it appeared A had acted "to convey her feelings to Jungkook" and that she did not appear to have intended to cause harm. The court also noted she had not penetrated deep into the interior living space of the home and that the degree to which she violated the emergency protective order was relatively minor.

The court also took into account that A had been held in detention for about three months in connection with the case, and that the risk of reoffending was not considered high given that she would likely be deported once the ruling is finalized.
